1. About these terms

These terms govern your use of Onsellr ("we", "our", "us") at onsellr.com — an online marketplace for buying and selling cars in Australia. By creating an account or using the site, you agree to these terms. If you don't agree, please don't use Onsellr.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract under Australian law to use Onsellr. By using the site you confirm you meet these requirements.

3. Your account

• You're responsible for keeping your login details secure.
• You must provide accurate information and keep it up to date.
• One person, one account. Don't impersonate others or create accounts on someone else's behalf without their permission.
• We may suspend or terminate accounts that breach these terms or abuse the platform.

4. Listings

When you list a vehicle on Onsellr you agree that:

• You own the vehicle (or are authorised to sell it) and can legally transfer title.
• The information, photos, price and condition you describe are accurate and not misleading.
• You hold any required dealer licence if you're selling in trade.
• You will not list stolen, written-off (where prohibited), unregistered (without disclosure), or otherwise illegal vehicles.
• You grant Onsellr a non-exclusive, royalty-free licence to display your listing content on the site and in promotional material related to your listing.

We reserve the right to remove listings that breach these terms, our content rules, or applicable law.

5. Buying

Onsellr is a marketplace — the contract of sale is between buyer and seller. We are not a party to the transaction and don't take possession of vehicles. You are responsible for inspecting the vehicle, verifying the seller, arranging payment safely, and completing roadworthy/registration transfer requirements in your state. We strongly recommend an independent pre-purchase inspection and a PPSR check before paying.

6. Fees and payments

Any fees and payment terms applicable to your use of Onsellr will be presented before you incur them and may be set out in a separate agreement with you. Fees are billed in Australian dollars (AUD) and are non-refundable except where required by law. Payments are processed by our third-party payment provider; we don't store full card details on our servers.

7. Acceptable use

You agree not to:

• Post false, misleading, defamatory, or unlawful content.
• Harass, threaten, or abuse other users.
• Scrape, harvest or redistribute listings, contact details, or other user content without our written permission.
• Attempt to circumvent fees, security controls, or rate limits.
• Use Onsellr to send spam, phishing, or fraudulent communications.
• Upload viruses, malware, or anything that could harm the site or its users.

8. Messaging

Messages sent through Onsellr's system may be reviewed for safety, fraud detection, and compliance with these terms. Don't share sensitive personal or financial information through the messaging system.

9. AI features

Onsellr uses AI to assist with deal scoring, pricing insights, listing descriptions and image enhancement. AI outputs are estimates and suggestions only — they are not financial, legal, mechanical, or valuation advice. You are responsible for verifying any AI-generated content before relying on it or publishing it.

10. Intellectual property

The Onsellr name, logo, design and software are owned by us and protected by copyright and trade mark laws. You retain ownership of the content you post (listings, photos, messages), and grant us the licence described in section 4 to operate the service.

11. Disclaimers

Onsellr is provided "as is". We don't warrant that listings are accurate, that the site will be error-free or uninterrupted, or that any particular outcome (sale, purchase, valuation) will be achieved. To the maximum extent permitted by law, we exclude all implied warranties. Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

12. Liability

To the maximum extent permitted by law, Onsellr is not liable for indirect or consequential loss, loss of profits, or loss of data arising from your use of the site or any transaction with another user. Our total liability to you for any claim is limited to the fees you have paid us in the 12 months before the claim arose.

13. Termination

You can close your account at any time via the data deletion page. We may suspend or terminate your access if you breach these terms, abuse the platform, or if required by law. Sections that by their nature should survive termination (fees owed, liability, intellectual property) will continue to apply.

14. Changes

We may update these terms from time to time. Material changes will be communicated by email or via a notice on the site. Continued use of Onsellr after changes take effect means you accept the updated terms.

15. Governing law

These terms are governed by the laws of Australia. You and Onsellr submit to the non-exclusive jurisdiction of the courts of Australia.
